Terms of Service

1. About These Terms

These Terms of Service govern your use of EHO App, a food safety compliance application operated by EHOapp ("we", "us", "our"). By creating an account or using the app, you agree to these terms.

If you do not agree, please do not use the service. We may update these terms from time to time — continued use after changes constitutes acceptance.

2. The Service

EHO App is a digital tool designed to help food businesses manage and record daily food safety compliance tasks based on the Food Standards Agency's "Safer Food, Better Business" framework.

3. Your Responsibilities

You are solely responsible for your food safety compliance. EHO App is a record-keeping and workflow tool — it does not replace professional food safety advice, EHO inspections, or your legal obligations as a food business operator.

We do not act as a food safety consultant, duty holder, or regulatory body. Completing checks in the app does not guarantee compliance with food safety legislation.

4. Accounts

You must provide a valid email address to create an account. One account represents one food business premises. You must not share account credentials or allow unauthorised access.

Manager (owner) accounts have full control over venue data, staff accounts, and subscription settings. Staff accounts are created by the manager and have limited permissions.

5. Free Plan and Pro Plan

Free plan: One owner account with access to all core compliance checks. Records are retained for a rolling 90-day window — records older than 90 days are automatically deleted. Open corrective actions are never deleted regardless of age.

Pro plan (£5/month): Unlimited staff accounts, EHO-ready PDF exports, CSV data exports, and extended record retention from your upgrade date onwards.

6. Free Trial

New venues are eligible for a single 7-day free trial of the Pro plan. The trial begins when your first invited staff member logs in. No payment details are required to start the trial.

Each venue is entitled to one trial only. If you cancel during the trial period, you will not be charged. After the trial, you may subscribe to the Pro plan via Direct Debit.

7. Subscription and Billing

Pro plan subscriptions are billed monthly at £5.00 via GoCardless Direct Debit. By subscribing, you authorise us to collect payments from your bank account on a recurring basis.

Your subscription will automatically renew each month until you cancel. Pricing may change with 30 days' written notice — continuing to use the service after a price change constitutes acceptance.

8. Cancellation and Refunds

You may cancel your subscription at any time from within the app. Cancellation takes effect immediately.

When you cancel:

You may resubscribe at any time. Returning subscribers are charged immediately with no additional trial period.

9. Data and Privacy

Your data is stored securely using Google Firebase (Firestore) with encryption in transit and at rest. We collect only the data necessary to operate the service: email address, venue name, and the compliance records you create.

We do not sell, share, or provide your data to third parties except as necessary to operate the service (Firebase for data storage, GoCardless for payment processing, Resend for transactional emails).

You may request a copy of your data or request deletion of your account by contacting us at support@ehoapp.com. Account deletion is permanent and cannot be reversed.

10. Data Processing Agreement

Where you (the venue) enter data into the app on behalf of your business — including staff names, compliance records, fitness-to-work logs, and other operational data — you are the Data Controller and EHOapp is the Data Processor under UK GDPR Article 28.

As Data Processor, EHOapp agrees to:

The "fitness to work" feature may involve recording staff health information, which is classified as Special Category Data under UK GDPR Article 9.

We reserve the right to suspend or terminate accounts that violate these terms.

13. Availability and Support

We aim to keep EHO App available at all times but do not guarantee uninterrupted service. Maintenance, updates, or circumstances beyond our control may cause temporary downtime.

The app requires an internet connection and a modern web browser. We do not guarantee compatibility with all devices or browsers.

14. Limitation of Liability

To the maximum extent permitted by law:

Nothing in these terms excludes liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

15. Crown Copyright and Open Government Licence

EHO App's compliance checklists are based on the Food Standards Agency's "Safer Food, Better Business" (SFBB) pack. This material is Crown copyright and is used under the Open Government Licence v3.0.

The original SFBB materials are published by the Food Standards Agency. EHOapp is not affiliated with, endorsed by, or connected to the Food Standards Agency.

16. Changes to the Service

We may add, modify, or remove features at any time. If we make changes that materially reduce the functionality of a paid plan, we will give 30 days' notice.

17. Governing Law

These terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the English courts.
